IEEPA Tariff Refunds Phase 3: What US Mold Buyers Should Know This Week

IEEPA tariff refunds entered a new phase this month, and US buyers of molds and parts sit in the middle of it. CBP launched Phase 3 of its CAPE refund system on October 6, opening refund claims on entries liquidated more than 80 days. Two days later, a federal court certified a nationwide class action covering importers who never sued. This Thursday, October 22, both sides must file proposed case schedules. If your company imported tools or parts that paid IEEPA duties, the moves below decide whether you get money back.

CAPE is CBP’s Consolidated Administration and Processing of Entries. It pays back the IEEPA duties the Supreme Court ruled unlawful in February 2026. Phase 3 went live on October 6 and covers entries liquidated more than 80 days. Plaintiffs file first. A new class action may open the door for everyone else.

The October 8 Ruling: A Class Action for Importers Who Never Sued

On October 8, Judge Richard K. Eaton certified a class in Freestyle World, Inc. v. United States, Slip Op. 26-123. The class covers importers of record who paid IEEPA duties between February 1, 2025 and February 19, 2026. Importers with their own refund suits are excluded. Everyone else is in automatically.

Under CIT Rule 23(b)(2), membership is mandatory. No opt-out exists. Barnes, Richardson & Colburn and Lieff Cabraser serve as class counsel. The court put the stakes plainly: about $30 billion would stay unrefunded without this mechanism.

Certification opens a legal path only. It orders no refunds and decides no merits. BDO’s breakdown of the class certification flags the practical limits: no injunction yet, no money moving under the class.

Phase 3 Is Live: Who Can File Right Now

CAPE Phase 3 opened October 6 for entries liquidated more than 80 days. Only importers with a pending CIT refund suit, the plaintiffs, can file under Phase 3 today. Importers who gave CBP their IOR number before July 30 could file on day one.

Miss that date and you join rolling bi-weekly batches. The cutoff divides batches, not eligibility. Day one brought 477 filings covering 425,517 entries. As of October 2, CBP had accepted $136.6 billion in claims and sent $126 billion to Treasury for payment.

No newer disbursement figures had appeared in trade media by October 20. IEEPA tariff refunds typically pay out 60 to 90 days after acceptance, with interest.

October 22: The Schedule Deadline That Sets the Pace

This Thursday, October 22, both sides must submit proposed scheduling orders. Those proposals set the briefing pace for the class-wide injunction, the order that would actually trigger refunds. The deadline stands, and no early-filed proposals had surfaced publicly as of October 20.

Do not expect a refund order before the government answers. Trade-law watchers see no shortcut around that step. Trade media had reported no formal government appeal of the certification as of October 18, and no filing had been confirmed by October 20. An appeal is still expected, and it would push any final resolution into 2027.

IEEPA Tariff Refunds and Your Duty Math

IEEPA tariff refunds change the landed-cost math on every tool and shipment you brought in during the window. Total duties collected reached about $166 billion across roughly 330,000 importers. Molds enter under HTSUS 8480, and the IEEPA refund touches only the IEEPA layer, not Section 301 or other duties.

Our US-China tariff relief list explains which plastic goods face changing rates, and why 8480 sits outside that relief. Quote every program in two numbers: today’s landed cost, and landed cost net of the expected refund. The injection molding cost sheet shows where duty sits inside your part economics.

The $30 Billion Gap: Why the Non-Plaintiffs Matter

Roughly $11.4 billion belongs to importers who never sued and whose entries finally liquidated. Their standalone path is a new suit under 28 USC 1581(i), within two years of the claim. Class membership is automatic, but BDO reads it as barring new individual suits.

Troutman Pepper Locke’s recovery tracker lays out the IEEPA, Section 122, and Section 301 tracks side by side. It notes the opinion stays silent on suits filed after certification. For importers with large finally-liquidated balances, a protective individual suit may still be the more certain path.

Watch the two-year clock under 28 U.S.C. § 2636(i). The certification order does not pause it.

ACH, Offsets, and Interest: The Plumbing Behind Your Refund

About $1.3 billion in refunds froze because importers had never registered ACH details. Since October 10, adding or changing ACH information needs email or SMS two-step verification. Log in to ACE and confirm your ACH refund enrollment before your batch processes.

CBP nets your refund against other disputed debts you owe, under 31 U.S.C. § 3716. Statutory interest runs 6 to 7 percent, compounded daily. That interest is real money on a large entry. Confirm your broker claimed it on every line.

What to Do This Week: A Buyer’s Checklist

Five moves, all doable before Friday.

  • Ask your broker: did we file a CIT refund suit, and is our IOR number in CBP’s Phase 3 queue?
  • Log in to ACE, confirm ACH refund enrollment, and clear the two-step verification before money is queued.
  • Watch the October 22 schedule proposals; they set the timeline for any class-wide refund order.
  • Write new tooling POs with a tariff clause that names the HTSUS line and assigns any refund rights.
  • For finally liquidated entries with no suit filed, get counsel’s read on the two-year deadline before relying on the class.

Resin price spikes hit the same landed-cost number from the other side. Model both together. If you are sourcing from China, keep tariff language in every PO until the legal picture settles.

The $30 billion question is whether the class mechanism survives appeal, and who files first if it does not.
